1. Acceptance of Terms

By accessing, using or attempting to interact with any part of the ISAY system, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy (available here). If you do not agree, you must not use the ISAY system.

2. Use of the ISAY system

• You agree to use the ISAY system for lawful purposes only and in a manner that does not violate any applicable national, or international laws or regulations.
• You agree not to engage in any conduct that may damage, disable, or impair the ISAY system, or interfere with any other user's use of the ISAY system.
• This ISAY system is designed to support the secure submission and processing of incident reports but is not intended for long-term storage of case files or related documents. Users are advised to retain separate records if needed.
• We reserve the right to update, modify, or discontinue any feature or functionality of the ISAY system at any time, without prior notice. Such changes may enhance, limit, or remove parts of the ISAY system's functionality.
• All reporting parties and users acknowledge that the intentional misreporting of any information is strictly prohibited, and that the intentional misuse of the ISAY system may result in criminal prosecution and/or civil liability.
• The ISAY system is not a substitute for reporting unlawful activity to law enforcement.

3. Account Registration

• To submit reports or access certain features of the ISAY system, you must create an account. This account may be created anonymously or with identifying information, depending on your preference at the time of reporting.
• If you choose to remain anonymous, the ISAY system will generate a random user ID and password for you. This allows you to follow up on your report and receive communications while maintaining your anonymity.
• If you choose to register with identifying details, you agree to provide accurate, current, and complete information during the registration process.
• You are responsible for maintaining the confidentiality of your login credentials—whether assigned or created—and for any activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or restrict access to the ISAY system if we detect misuse, abuse, or excessive use that may threaten the integrity or availability of the ISAY system. Access may also be suspended in case of non-compliance with these Terms.

4. Incident Reporting

• You may use the ISAY system to report incidents. You have the option to submit reports anonymously or with your identity, as you prefer.
• By submitting a report, you confirm that the information provided is true, accurate, and complete to the best of your knowledge.
• We reserve the right to investigate and take appropriate action on all reports submitted through the ISAY system. This may include initiating internal disciplinary proceedings or, where applicable, referring the matter to competent authorities for criminal prosecution or any other legal investigation.

5. Privacy and Data Protection

• This processing is carried out in accordance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR), where applicable.
• The ISAY system also applies appropriate technical and organizational measures to protect user data from unauthorized access, loss, or misuse.
• The ISAY system Privacy Policy governs the collection, use, and protection of your personal data. By using the ISAY system, you agree to the collection and use of data in accordance with our Privacy Policy.
• If a user is later identified as a minor during the report process, we will ensure that special care is taken to protect their personal data. However, we do not actively collect information to identify minors and will treat all users' data with the same level of care and attention. If it becomes known during the process that a report was submitted by a minor, we will take appropriate steps to protect the individual's rights and may seek guardian consent when necessary and legally applicable.
• The ISAY system may use cookies to improve performance and user experience, as outlined in the Privacy Policy. You can manage your cookie preferences through your browser settings.
• Access to report content is limited to authorized personnel with a specific operational need and is subject to role-based access controls and confidentiality obligations.

6. Content Ownership and Restrictions

• All content on the ISAY system, including text, graphics, logos, and images, is the property of IGNITX or its licensors and is protected by copyright and intellectual property laws.
• You may not reproduce, modify, distribute, or otherwise use any content from the ISAY system for commercial purposes without prior written permission.

7. Limitation of Liability

• To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, regarding the ISAY system, including but not limited to the accuracy, reliability, or completeness of the information provided.
• We shall not be liable for any damages arising from the use or inability to use the ISAY system, including any direct, indirect, incidental, special, or consequential damages.
• Under no circumstances shall the ISAY system be liable for any indirect, incidental, consequential, or punitive damages, including lost profits or data.
• The ISAY system is not responsible and provides no guarantee for the accuracy, reliability, completeness, timeliness, or validity of any information related to incidents and concerns submitted anonymously and confidentially by the reporting parties and subsequently reported to the relevant recipients.

8. Indemnification

• You agree to indemnify and hold harmless IGNITX, the ISAY system, its affiliates, employees, and partners from any claims, losses, damages, liabilities, or expenses (including legal fees) arising from your use of the system, submission of false or unlawful reports, or violation of these Terms of Use.

9. Changes to Terms of Use

• We reserve the right to modify or update these Terms of Use at any time. Any changes will be posted on this page with an updated "Last updated" date. Your continued use of the ISAY system after any such changes constitutes your acceptance of the new Terms of Use.

10. Governing Law

• These Terms are governed by and construed in accordance with the laws of Estonia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia.

11. Miscellaneous

• Failure to enforce any provision of these Terms shall not be deemed a waiver of such provision nor of the right to enforce such provision, and a waiver by us of any right under these Terms on any occasion will not in any way constitute a waiver of such right or any other right on any other occasion. In the event any provision of these Terms is determined to be invalid, such invalidity will not affect the validity of the remaining portions of these Terms, and the parties will substitute for the invalid provision a provision which most closely approximates the intent and economic effect of the invalid provision.
• Your access to, or use of, the ISAY system may be prohibited by law in certain countries or jurisdictions. You are responsible for compliance with any applicable laws of the country from which you are accessing the ISAY system.
